Participation Agreement, Assumption of Risk & Liability Waiver
Effective Date: March 1, 2026
IMPORTANT — PLEASE READ CAREFULLY BEFORE REGISTERING. This is a legally binding Agreement between you (the “Parent/Guardian”) acting on behalf of yourself and your minor child (the “Participant”) and Union City Football Club, LLC (“UCFC”). By completing online registration and payment, you confirm you have read, understood, and agreed to every term below. Under New York’s Electronic Signatures and Records Act (ESRA), your electronic acceptance carries the same legal force as a handwritten signature. The date and time recorded by the UCFC registration system at the moment of checkout submission is the binding date of this Agreement.
1. Event Information
Organization: Union City Football Club, LLC (“UCFC”), a limited liability company organized under the laws of the State of New York.
Event: UCFC Spring Soccer Camp — 2026
Dates: April 6 – April 11, 2026 (six days)
Training Location: East River Park – Grand Street – Soccer 01, Manhattan, New York
Game Day Location: Randall’s Island Park – Wards Meadow Fields, Soccer Field 74, New York
Ages: born 2010–2017 (U10–U16), ages 9–16
Staff: DFB & UEFA licensed paid coaches. Unpaid volunteers may assist with non-coaching duties.
This Agreement applies to all training sessions, the game day, and any other activities conducted under the UCFC Spring Soccer Camp program. Spectators — including parents and guardians — are welcome to watch from designated areas, provided they do not interfere with coaching, disrupt the session, or endanger participants. UCFC reserves the right to ask any spectator to leave.
Age Confirmation: By accepting this Agreement, the Parent/Guardian confirms the Participant was born between 2010 and 2017 and meets the U10–U16 age eligibility requirements.
2. Nature of the Activity and Assumption of Risk
Soccer is a vigorous full-contact sport. The Parent/Guardian acknowledges that participation carries inherent risks that exist regardless of the skill, training, or supervision provided, including but not limited to:
• Player-to-player collisions and physical contact
• Falls, trips, and impact with playing surfaces, goals, or equipment
• Sprains, strains, muscle or ligament tears, dislocations, and fractures
• Head, neck, and spinal injuries
• Concussions and traumatic brain injuries
• Heat exhaustion, heat stroke, and dehydration
• Cardiovascular events
• Communicable illness or disease
• Serious injury, permanent disability, or death
The Parent/Guardian understands these risks exist even when UCFC exercises reasonable care. By accepting this Agreement, the Parent/Guardian, on behalf of themselves, the Participant, their heirs, executors, administrators, and assigns, voluntarily and knowingly assumes all inherent risks of participation.
3. Concussion Protocol (New York State Law)
Union City Football Club, LLC complies with the New York State Concussion Management and Awareness Act. Any Participant suspected of sustaining a concussion — by a coach, staff member, or parent/guardian — will be immediately removed from all activity. The Participant will not be permitted to return to any UCFC activity on the same day, regardless of how they feel. The Participant may not return to camp until a licensed medical professional provides written medical clearance. UCFC staff are not trained to diagnose concussions and will not make medical determinations. Emergency services will be called when warranted.
4. Liability Release and Indemnification
4a. Release of Parent/Guardian’s Own Claims
To the fullest extent permitted by the laws of the State of New York, the Parent/Guardian, individually and on behalf of their heirs, executors, and assigns, hereby releases, waives, discharges, and covenants not to sue Union City Football Club, LLC and its members, managers, paid employees, volunteers, agents, representatives, affiliated organizations, field facility operators, and contractors (collectively, “Released Parties”) from any and all claims, demands, losses, damages, costs, or liabilities — including attorney’s fees — arising from or in any way related to the Participant’s participation in the UCFC Spring Soccer Camp, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
4b. Notice Regarding Minor’s Independent Claims
IMPORTANT: Under New York law, a parent or guardian cannot legally waive a minor child’s own right to bring a negligence claim on their own behalf. Nothing in this Agreement purports to extinguish any independent legal right the Participant may have as a minor. However, by accepting this Agreement, the Parent/Guardian acknowledges the inherent nature of the risks described in Section 2, and represents that this Agreement has been entered into freely, voluntarily, and with full understanding of its terms.
4c. Indemnification and Defense
The Parent/Guardian agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and attorney’s fees — including any claim brought by or on behalf of the Participant — arising out of or resulting from the Participant’s participation in the UCFC Spring Soccer Camp. This indemnification obligation survives termination of this Agreement and applies whether or not UCFC is covered by any insurance policy at the time of the claim.
Insurance Notice: Union City Football Club, LLC does not currently carry general liability, accident, or participant injury insurance. The Released Parties are not insured against claims arising from camp participation. The Parent/Guardian is solely responsible for ensuring that the Participant has adequate personal medical and accident insurance for the duration of the camp.
Insurance Confirmation: By accepting this Agreement, the Parent/Guardian represents and confirms that the Participant has personal medical or accident insurance in effect covering the camp dates, or that the Parent/Guardian accepts full financial responsibility for any and all medical expenses incurred.
5. Medical Authorization and Emergency Treatment
In the event of an injury or medical emergency during camp activities, the Parent/Guardian authorizes UCFC’s paid staff and any volunteers present to: (a) administer basic first aid; (b) call emergency services (911); and (c) consent to emergency medical treatment on behalf of the Participant when the Parent/Guardian cannot be reached in time for a time-sensitive decision. This authorization is granted to paid employees and volunteers alike and extends to any licensed medical personnel who respond to an emergency.
The Parent/Guardian agrees to assume full financial responsibility for any medical services rendered. UCFC staff will make reasonable efforts to contact the Parent/Guardian and the emergency contact listed at registration immediately following any incident.
6. Fees and Payment
Participation in the UCFC Spring Soccer Camp requires the following payments:
• $50.00 — Non-Refundable Registration Fee, due at the time of registration (online or by phone)
• $200.00 — Camp Tuition, due no later than March 30, 2026
• $250.00 — Total per Participant
Spot Confirmation: A registered spot is not confirmed until both payments are received in full.
Forfeiture: Failure to submit the $200.00 tuition balance by March 30, 2026 will result in automatic forfeiture of the registered spot. Forfeited spots may be offered to waitlisted participants without prior notice. The $50.00 registration fee is not refunded upon forfeiture.
7. Refund Policy
Registration Fee ($50.00): Non-refundable under all circumstances, without exception.
Camp Tuition ($200.00): Refundable only if a written cancellation request is received on or before March 30, 2026. Cancellation requests must be submitted by email to ucfc.nyc@gmail.com with the subject line “Camp Cancellation – [Participant’s Full Name].” Requests made by phone, text message, verbal communication, or any other means will not be accepted or honored. After March 30, 2026, no refund of the tuition will be issued for any reason, including but not limited to illness, injury, scheduling conflicts, voluntary withdrawal, missed sessions, or dissatisfaction.
UCFC-Initiated Full Cancellation: In the event that Union City Football Club, LLC cancels the entire UCFC Spring Soccer Camp prior to its start date, all fees paid — including the $50.00 registration fee and the $200.00 tuition — will be refunded in full within 14 business days. This is the only circumstance under which the registration fee is refundable.
Session-Level Cancellations: No refund will be issued for cancellations, modifications, or interruptions of individual sessions due to weather, field conditions, public health events, force majeure, or any other cause. Make-up sessions are not guaranteed.
Misconduct: Removal of a Participant from camp due to conduct described in Section 8 does not entitle the Parent/Guardian to any refund of fees paid.
8. Participant and Spectator Conduct
Participant Conduct: Union City Football Club, LLC reserves the right to remove any Participant from the camp immediately and without refund for behavior including but not limited to: dangerous or reckless play; failure to follow coach or staff instructions; bullying, harassment, or threatening behavior; physical violence or aggression; conduct that endangers others; or any behavior deemed by UCFC staff to be incompatible with a safe and positive training environment. UCFC’s decision regarding conduct is final.
Spectator Conduct: Parents and guardians are welcome to watch sessions from designated spectator areas. Spectators must not interfere with coaching, enter the field of play, verbally or physically engage with coaches, staff, or other participants in a disruptive manner, or otherwise compromise the safety or focus of the session. UCFC reserves the right to ask any spectator to leave. Repeated disruptive behavior by a spectator may result in the Participant being asked to withdraw from camp.
9. Arrival, Departure, and Supervision
Union City Football Club, LLC supervision applies exclusively during scheduled camp hours at the designated field locations. Parents/guardians are solely responsible for the Participant’s safe transportation to and from each location each day. Participants may not leave the training area during scheduled hours without first notifying a supervising coach. UCFC is not responsible for Participants before they arrive at or after they are dismissed from each daily session.
10. Required Equipment
Participants must arrive with the following items each day:
• Soccer training attire appropriate for outdoor conditions
• Shin guards — mandatory; Participants without shin guards will not be permitted to train
• Outdoor soccer cleats suitable for artificial turf
• Personal water bottle
Participants who arrive without required equipment may be excluded from that session for safety reasons. No refund will be issued for sessions missed due to missing or improper equipment.
11. Weather Policy and Force Majeure
The camp operates rain or shine. In the event of lightning, severe weather, field closures ordered by park authorities, public health emergencies, government-mandated restrictions, facility unavailability, or any other circumstance beyond Union City Football Club, LLC’s reasonable control (“Force Majeure”), UCFC may modify, relocate, or cancel individual training sessions or game day without liability or obligation to issue refunds. Families will be notified as promptly as practicable using the contact information provided at registration. Make-up sessions are not guaranteed.
12. Photo and Video Release
By accepting this Agreement, the Parent/Guardian grants Union City Football Club, LLC and its authorized representatives an irrevocable, perpetual, royalty-free license to photograph and record the Participant during all camp activities, and to use the Participant’s image, video, likeness, and name for UCFC marketing, promotional materials, website, and social media content, without additional notice, approval, or compensation. All media created during camp activities is the property of Union City Football Club, LLC.
Opt-Out: Parents/guardians who do NOT consent to photo or video use of their child must send written notice to ucfc.nyc@gmail.com with the subject line “Photo Opt-Out – [Participant’s Full Name]” before April 6, 2026. Opt-out requests received after the camp begins cannot be applied retroactively.
13. Data Privacy
Union City Football Club, LLC collects the following information solely to administer the camp and protect participant safety: participant name, date of birth, parent/guardian name and contact information, emergency contact details, and medical conditions or allergies. This information is stored securely and will not be sold or disclosed to any third party except as required by applicable law or necessary for emergency medical treatment. By accepting this Agreement, the Parent/Guardian consents to this collection and use. Questions may be directed to ucfc.nyc@gmail.com.
14. Camp Completion
Participants who attend and complete the full UCFC Spring Soccer Camp will receive a Certificate of Participation and a UCFC Camp T-Shirt. Distribution is subject to full attendance and item availability.
15. Severability
If any provision of this Agreement is found invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect without interruption.
16. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the Participant’s participation in the UCFC Spring Soccer Camp and supersedes all prior verbal statements, written representations, marketing materials, or understandings of any kind. No coach, staff member, or volunteer has authority to modify the terms of this Agreement verbally or in writing.
Enforceability Upon Rescheduling: This Agreement remains fully enforceable in the event that the UCFC Spring Soccer Camp is rescheduled, in whole or in part, to different dates, times, or locations due to weather, field unavailability, force majeure, or any other reason within or beyond UCFC’s control. Rescheduling does not void, modify, or diminish any provision of this Agreement, including the liability release, assumption of risk, indemnification, and refund policy. The Parent/Guardian’s acceptance of this Agreement extends to all rescheduled sessions and activities conducted under the UCFC Spring Soccer Camp program, regardless of when or where they take place.
17. Governing Law and Dispute Resolution
Governing Law: This Agreement is governed by the laws of the State of New York, without regard to conflict of law principles.
Dispute Resolution — Litigation: Any dispute, claim, or controversy arising out of or relating to this Agreement or the Participant’s participation in the UCFC Spring Soccer Camp shall be resolved exclusively in the state courts of New York County, New York, or the U.S. District Court for the Southern District of New York. The Parent/Guardian hereby irrevocably consents to personal jurisdiction in these courts and waives any objection to venue.
Why Litigation: This Agreement intentionally elects litigation over arbitration. Arbitration requires both parties to pay a private arbitrator at rates of $200–$5,000 per hour, which would impose disproportionate costs on a small organization like UCFC. New York state court filing fees are approximately $200, the process is publicly accountable, and both parties retain full appeal rights. This is the fairer forum for disputes of this nature.
18. Electronic Acceptance and Signature
New York Electronic Signatures and Records Act (ESRA): Completion of online registration and payment on the UCFC Squarespace registration portal constitutes full electronic acceptance of this Agreement, enforceable under New York’s Electronic Signatures and Records Act (ESRA). The following are recorded and retained by the registration system as proof of acceptance:
• Parent/Guardian full name (typed at checkout)
• Email address used at checkout
• IP address of the device used at time of registration
• Date and time stamp of checkout submission
• Confirmation that the agreement checkbox was checked prior to payment
Record Delivery: A copy of this Agreement will be sent to the Parent/Guardian’s email address on file following registration. Copies may also be requested at any time by emailing ucfc.nyc@gmail.com.
Consent to Electronic Records: The Parent/Guardian consents to receive all documents, notices, and records relating to this Agreement electronically. The Parent/Guardian confirms they have the ability to access and retain electronic documents.
19. Parent/Guardian Acknowledgment
By electronically accepting this Agreement or signing below, the Parent/Guardian confirms that they:
• Have read this Agreement in its entirety and understand all of its terms
• Voluntarily assume all inherent risks of soccer participation on behalf of themselves and the Participant
• Release and hold harmless the Released Parties from the Parent/Guardian’s own claims to the fullest extent permitted by New York law
• Agree to indemnify and defend the Released Parties against all claims, including those brought on behalf of the Participant
• Confirm the Participant was born between 2010 and 2017 (U10–U16, ages 9–16)
• Confirm the Participant has personal medical or accident insurance, or accept full financial responsibility for medical costs
• Agree to the payment terms in Section 6 and the refund policy in Section 7
• Consent to photo and video use as described in Section 12, unless they have opted out
• Consent to the collection and use of personal data as described in Section 13
• Authorize the Participant to participate in the UCFC Spring Soccer Camp, April 6–11, 2026
• Understand they are giving up substantial legal rights by signing this Agreement
By completing online registration, I confirm I have read, understood, and agreed to all terms of this Agreement.
